<h2 class="wp-block-heading">This article highlights the false 498a case judgement by Supreme Court where Men and family suffered for 23 years.</h2>



<p class="wp-block-paragraph">In a significant judgment, the Hon’ble Supreme Court of India quashed a false dowry harassment case filed in 2002 against Mr. Ghanshyam Soni and his family, citing lack of evidence, vagueness of allegations, and gross delay. While this long-overdue relief to the falsely accused is welcome, but the apex court did not initiate any action against the complainant who misused the law. The woman just dragged a man and his entire family through 23 years of trauma, and escaped any consequences.</p>



<p class="wp-block-paragraph">The case involved generic, unsubstantiated allegations, no medical or corroborative evidence, and clear signs of misuse of legal provisions to harass aged parents-in-law, five sisters-in-law, and even a local tailor. The Supreme Court invoked Article 142 to quash FIR No. 1098/2002 and the chargesheet, admitting that the entire proceedings were unjustified.</p>

<p class="wp-block-paragraph">&#8220;<strong><em>No punishment for false accusers only encourages them further</em></strong>&#8220;, quotes Kumar S Ratan, Founder of Men Helpline.</p>
</blockquote>



<p class="wp-block-paragraph">Yet, despite acknowledging the abuse of law, the Court:</p>



<ul class="wp-block-list">
<li>Did not take suo motu cognizance of the false complaint,</li>



<li>Issued no guidelines to prevent such misuse in the future,</li>



<li>And did not recommend punishment or perjury proceedings against the false accuser.</li>
</ul>



<h3 class="wp-block-heading">Is this a Double Standard?</h3>



<p class="wp-block-paragraph">This judgment raises an uncomfortable question:</p>

<p class="wp-block-paragraph">What if a man had falsely accused a woman and dragged her through courts for 23 years?</p>
</blockquote>



<p class="wp-block-paragraph">It can be easily imagined the outrage, contempt, and possibly harsh imprisonment that would have followed. But when a woman misuses the law and destroys a man&#8217;s life and reputation for two decades, the system quietly lets it go — offering a symbolic justice in the name of justice, without accountability.</p>



<h3 class="wp-block-heading">The Bigger Problem: Misuse Without Consequences</h3>



<p class="wp-block-paragraph">The Supreme Court on multiple occasions has acknowledged the rampant misuse of Section 498A IPC, but:</p>



<ul class="wp-block-list">
<li>No concrete safeguards are in place to stop misuse.</li>



<li>There is no mechanism to restore the dignity or compensate the falsely accused.</li>



<li>The judicial system continues to remain silent on prosecuting false complainants (specifically women), creating an environment where innocent men live in fear and shame for years, while accusers remain untouchable.</li>
</ul>



<h3 class="wp-block-heading">Our Stand</h3>



<p class="wp-block-paragraph">We at Men Helpline (group) demand:</p>



<ul class="wp-block-list">
<li>Punishment for false accusers under IPC sections like perjury and malicious prosecution.</li>



<li>Suo motu guidelines by the Supreme Court to stop blanket arrests and frivolous cases.</li>



<li>Legal reforms to balance gender laws and protect innocent men and families.</li>
</ul>



<p class="wp-block-paragraph">Justice delayed is injustice. But justice denied for the falsely accused — without any accountability for the false accuser — is not just injustice, it is also ignorance of the of the rule of law.</p>

<li>Alleged she aborted pregnancy without his consent.</li>

<li>Her testimony was inconsistent, and allegations of abuse and adultery were not substantiated.</li>



<li>Court found that she left her husband without sufficient reason.</li>

<li>They are living separately by mutual consent.</li>



<li>Since the Court ruled she left without sufficient reason, maintenance was denied.</li>

<p class="wp-block-paragraph">The case involved Bhushan Kumar Meen, who challenged the order directing him to pay ₹10,000 per month as interim maintenance to his estranged wife, Mansi Meen, despite his net take-home salary being just ₹9,000, after deductions including a heavy home loan EMI of over ₹21,000.</p>



<p class="wp-block-paragraph">Bhushan argued that the interim maintenance was more than his actual take-home salary and that his wife, being well-educated, was capable of earning and maintaining herself.</p>



<p class="wp-block-paragraph">The wife, however, maintained that given the husband’s gross salary and her own current unemployment, the maintenance was justified.</p>

<p class="wp-block-paragraph">Recognizing the financial strain on the husband, the Court reduced the interim maintenance to ₹5,000 per month.</p>



<ul class="wp-block-list">
<li>It observed that while the wife was currently unemployed, her qualifications indicated that she could earn in the future.</li>



<li>The Court emphasized that maintenance should be reasonable and within the paying capacity of the husband.</li>



<li>It also allowed the recalculation of arrears based on the revised amount and gave the husband time to clear dues in installments.</li>

<p class="wp-block-paragraph">The Karnataka High Court recently took a strong stand against the misuse of dowry harassment laws in the case of C B Prakash vs. State of Karnataka. This judgment safeguards individuals from false accusations and upholds the integrity of the legal system.</p>

There are even scores and scores of cases where every member of the family without rhyme or reason is dragged into the web of crime by frivolous complaints registered by the complainant/wife while the entire grievance is against the husband and every imaginary member of the family is dragged in. It is these cases which are to be nipped in the bud. Bud, I mean, at the stage of registration of the crime&#8221;, the bench in noted.</p>

<p class="wp-block-paragraph">In the case, the wife filed a complaint under Section 498A against her husband and his parents just two months after their marriage in October 2021. The couple faced marital discord after the husband relocated to Germany for work.</p>



<p class="wp-block-paragraph"><strong><em>Justice Nagaprasanna</em></strong> emphasized the misuse of Section 498A in marital disputes and the lack of specific allegations against the elderly in-laws in this case. The court, upon reviewing the charge sheet, found no reason to include the husband&#8217;s parents in the investigation.</p>

<h2 class="wp-block-heading">Arrest in dowry harassment cases and affect of complying the Section 41 of Code of Criminal Procedure (Cr.P.C.)</h2>



<p class="wp-block-paragraph">By following the procedure as in Section 41a of CrPC may protect from arrest in 498a cases. Section 41 of Code of Criminal Procedure (Cr.P.C.) talks about provisions and power of police officers to arrest a person accused without a warrant. </p>



<p class="wp-block-paragraph">That police officer may arrest a person who is accused in a cognizable offense. Police officer may also arrest a person if police has received credible information against the accused person. Police officer has to mention the reason of arrest in such a case where arrest is required, and the person has to be brought before a magistrate within 24 hours of arrest.</p>



<p class="wp-block-paragraph">However due to lack of guidelines regarding process of how to issue notice under Sec 41 of CrPC, sometime it cause unnecessary arrest of accused persons. So the methods of delivering and issuing notice under the said section plays an important role.</p>



<p class="wp-block-paragraph">In many arrest scenarios, it is often noted that individuals are arrested because they either refuse to acknowledge the notice issued under Cr.P.C. 41A or fail to disclose their identity. Therefore, <strong><em>it is strongly recommended to acknowledge or receive the 41A notice and promptly sign the copy with the time and date of receipt</em></strong>.</p>
