<p><b><i>We urge the Indian Court, Ministry of Law and the Law Commission to enact legislation considering the no-fault model of divorce in India.</b></i></p>


<p><h3>Introduction:</h3></p>

<p><b>Family law should prioritize</b> fairness, compassion, and efficiency, especially in cases of divorce. The legal system should not encourage a cycle of blame or force families into prolonged conflict.</p>

<p>Marriage is a significant commitment, but sometimes relationships break down irreparably. In today’s world, families cannot afford to spend years in legal battles. Many couples do not wish to blame each other; instead, they <b>seek a respectful and dignified way to end their marriage,</b> rather than getting caught in an endless cycle of accusations.</p>

<p>With the outdated and adversarial &#8220;fault-based&#8221; models current divorce model exacerbate conflict and prolong suffering. It&#8217;s time to modernize our approach to divorce and adopt a more humane and constructive system with &#8220;No-Fault Divorce&#8221; model.</p>

<p><h3>Divorce Model</h3></p>

<p>Under the current model of divorce in India, couples are often forced into unnecessary conflict, blame, and lengthy legal battles that serve no one&#8217;s best interests and it become more worse when children are involved.</p>

<p>A No-Fault Divorce Model allows couples to dissolve their marriage without any blame, significantly reducing emotional distress, legal costs, and time-consuming litigation. Many progressive countries have already adopted this model, and it has been proven to promote more amicable separations, healthier co-parenting, and overall social well-being.</p>


<p><h3>The Problem with Fault-Based Divorce</h3></p>

<p>In fault-based divorce systems, one spouse have to prove the other’s fault for the breakdown of the marriage. This approach forces couples into an adversarial process that often includes:</p>

<li>Blame and Accusation: Spouses must accuse each other of wrongdoing, such as adultery, abuse, abandonment, or cruelty. This fuels resentment, making amicable co-parenting and future communication incredibly difficult.</li>
<li>Increased Conflict and Legal Battles: Proving fault requires extensive legal maneuvering, investigation, and emotionally charged courtroom battles. This significantly increases legal costs and prolongs the divorce process, adding unnecessary stress and financial strain on families.</li>
<li>Invasion of Privacy: Deeply personal and often embarrassing details of the marriage are made public, causing further emotional distress and damage to reputations.</li>
<li>Unequal Power Dynamics: The fault system can be weaponized, creating power imbalances where one spouse may feel pressured or intimidated into accepting unfavorable settlements to avoid public accusations or lengthy legal battles.</li>
<li>Negative Impact on Children: Children are often caught in the middle of fault-finding disputes, witnessing their parents engage in bitter conflict, leading to emotional distress and instability.</li>
</ul>

<p><h3>The Solution: No-Fault Divorce</h3></p>

<p>A No-Fault Divorce Model provides a more constructive and modern approach, recognizing that sometimes marriages break down irreparably, and neither party needs to be blamed.</p>

<li>Focus on Resolution, Not Blame: Divorce is treated as a personal matter, not a legal contest of who is &#8220;at fault.&#8221; The focus shifts to fair resolutions for finances, property division, and child custody, without requiring proof of fault.</li>
<li>Reduced Conflict and Acrimony: Removing the need to prove fault significantly reduces hostility, fostering a more cooperative environment and encouraging amicable settlements and healthier co-parenting relationships.</li>
<li>Simplified and More Efficient Process: No-fault divorce streamlines legal proceedings, reducing court time, legal fees, and emotional exhaustion. This allows individuals to move forward with their lives more quickly and with less financial and emotional burden.</li>
<li>Protected Privacy: Personal details remain private, as the focus is on practical aspects of separation, rather than public airing of grievances.</li>
<li>More Compassionate and Realistic Approach: No-fault divorce acknowledges reality—relationships can end without assigning blame. It promotes a respectful and dignified process during a difficult life transition.</li>
<li>Potentially Reduces Domestic Violence Risk: In some cases, fault-based systems trap individuals in abusive relationships because proving fault could escalate conflict. No-fault divorce provides a safer and more accessible exit.</li>

<p>We urge the Indian Court and lawmakers to take immediate steps to implement Joint Parenting Model in child custody laws across the country. The current child custody framework favors single-parent custodial system, which results in the alienation of one parent from the child&#8217;s life.</p>

<p>The existing outdated system fails to prioritize the child&#8217;s emotional and developmental needs, essentially granting custody to one parent while granting visitation to the other parent (often the father) as a concession to a &#8220;loser.&#8221;</p>

<p>Instead of prioritizing the well-being of the child, the existing custody model encourages cycles of blame, and prolonged legal battles between parents, often weaponizing children as leverage in disputes. The current system disregards the critical concept of co-parenting, which is essential for a child&#8217;s upbringing.</p>

<p>Research and global examples clearly demonstrate that children raised under joint parenting arrangements tend to thrive emotionally, socially, and academically. Joint parenting allows both parents to share responsibilities, ensuring the child receives love, care, and guidance of both parents. It ensures the child learns to build bonds, fostering a sense of stability and continuity in their life.</p>

<p>Article 39 of the Constitution of India guarantees child protection and rights. Parenting rights, as part of the guarantee, should not be denied to one parent. By implementing Joint Parenting Model, we can uphold the constitutional principles of prioritizing the child&#8217;s best interests.</p>

<p>We respectfully call upon lawmakers, the judiciary, and all relevant stakeholders to reform child custody laws to make Joint Parenting the default framework. Such reform will not only protect the rights of child but, more importantly, ensure the overall development and happiness of children caught in custody disputes.</p>
