India’s divorce system needs urgent reform to address the needs of the modern families. The century old law has failed to align with modern societal realities and to prioritize the mental health and well-being of families.

We call to end the blame game in divorce proceeding by promoting the amicable solutions.

The current practice in divorce fuels cycle of blame on each other during proceedings. Such practice of law and legal system has completely denied the concept of “end of marriage with dignity”, however the model should have prioritized amicable separations and no-fault divorce but it promotes fosters a bitter and lifelong battle.

The existing divorce model follows a fault-based grounds such as adultery, desertion, or cruelty which requires trial to prove the allegation which essentially leads to prolonged and acrimonious legal battles that inflict immense emotional and financial distress, particularly on men and children. When young individuals are entangled in contentious legal disputes over failed relationships, it affects their personal development and lead to depression, ultimately affecting the nation’s growth.

“The divorce model, instead of promoting the amicable separations, the current system incentivizes blame games and encourages a culture of litigation which not only exacerbates existing tensions but also creates significant barriers to healing and moving forward.”, Kumar S Ratan Men’s and Child Rights Activist

This fault-based divorces typically run for average 4-6 years, often starting with criminal cases like “Dowry Harassment” against men. These cases are followed by multiple mediation sessions, frequently dominated by financial settlements. Such practices further erode the dignity of marriage dissolution and perpetuate a cycle of conflict.

The Proposed Models:

• No-Fault Divorce: to shift towards a no-fault divorce system, where the irretrievable breakdown of a marriage (IRBM) is sufficient grounds for separation, would allow couples to end their relationships with dignity and minimize the trauma associated with the process. This approach would prioritize the well-being of all parties involved, particularly children, by facilitating smoother transitions and reducing the potential for prolonged conflict.

• Prenuptial Agreements: Recognizing the evolving nature of modern relationships, the legal framework should accommodate Prenuptial Agreements. These agreements can help couples establish clear expectations regarding finances, assets, and responsibilities before marriage, reducing the potential for disputes during divorce proceedings.

Highlighting the Plight of Parents:

The current system often leaves parents, particularly fathers, feeling alienated from their children. Cases like that of Atul Subhas, who did not have the access to his child since the age of three months of the kid, and Alok Mittal case, who has only seen his child for a brief period 9-days, are tragically common. These heartbreaking situations highlight the urgent need for reforms that prioritize the best interests of children and ensure that both parents have meaningful roles in their lives.

Call to Action:

Lawmakers must recognize the limitations of the current divorce laws and take immediate steps to modernize the system. This includes:

• Introducing a no-fault divorce ground.
• Prioritizing the best interests of children in all divorce proceedings.
• Implementing measures to facilitate amicable settlements and reduce the need for lengthy court battles.
• Ensuring Joint parental rights and responsibilities.
• Recognizing and upholding the validity of Prenuptial Agreements.

By these reforms, India can create a divorce system that is more just, compassionate, and better equipped to support families in navigating the complexities of separation.

To Whom It May Concern,

We urge the Indian Court, Ministry of Law and the Law Commission to enact legislation considering the no-fault model of divorce in India.

Introduction:

Family law should prioritize fairness, compassion, and efficiency, especially in cases of divorce. The legal system should not encourage a cycle of blame or force families into prolonged conflict.

Marriage is a significant commitment, but sometimes relationships break down irreparably. In today’s world, families cannot afford to spend years in legal battles. Many couples do not wish to blame each other; instead, they seek a respectful and dignified way to end their marriage, rather than getting caught in an endless cycle of accusations.

With the outdated and adversarial “fault-based” models current divorce model exacerbate conflict and prolong suffering. It’s time to modernize our approach to divorce and adopt a more humane and constructive system with “No-Fault Divorce” model.

Divorce Model

Under the current model of divorce in India, couples are often forced into unnecessary conflict, blame, and lengthy legal battles that serve no one’s best interests and it become more worse when children are involved.

A No-Fault Divorce Model allows couples to dissolve their marriage without any blame, significantly reducing emotional distress, legal costs, and time-consuming litigation. Many progressive countries have already adopted this model, and it has been proven to promote more amicable separations, healthier co-parenting, and overall social well-being.

The Problem with Fault-Based Divorce

In fault-based divorce systems, one spouse have to prove the other’s fault for the breakdown of the marriage. This approach forces couples into an adversarial process that often includes:

Blame and Accusation: Spouses must accuse each other of wrongdoing, such as adultery, abuse, abandonment, or cruelty. This fuels resentment, making amicable co-parenting and future communication incredibly difficult.

Increased Conflict and Legal Battles: Proving fault requires extensive legal maneuvering, investigation, and emotionally charged courtroom battles. This significantly increases legal costs and prolongs the divorce process, adding unnecessary stress and financial strain on families.

Invasion of Privacy: Deeply personal and often embarrassing details of the marriage are made public, causing further emotional distress and damage to reputations.

Unequal Power Dynamics: The fault system can be weaponized, creating power imbalances where one spouse may feel pressured or intimidated into accepting unfavorable settlements to avoid public accusations or lengthy legal battles.

Negative Impact on Children: Children are often caught in the middle of fault-finding disputes, witnessing their parents engage in bitter conflict, leading to emotional distress and instability.

The Solution: No-Fault Divorce

A No-Fault Divorce Model provides a more constructive and modern approach, recognizing that sometimes marriages break down irreparably, and neither party needs to be blamed.

Why No-Fault Divorce is the Right Solution

Focus on Resolution, Not Blame: Divorce is treated as a personal matter, not a legal contest of who is “at fault.” The focus shifts to fair resolutions for finances, property division, and child custody, without requiring proof of fault.

Reduced Conflict and Acrimony: Removing the need to prove fault significantly reduces hostility, fostering a more cooperative environment and encouraging amicable settlements and healthier co-parenting relationships.

Simplified and More Efficient Process: No-fault divorce streamlines legal proceedings, reducing court time, legal fees, and emotional exhaustion. This allows individuals to move forward with their lives more quickly and with less financial and emotional burden.

Protected Privacy: Personal details remain private, as the focus is on practical aspects of separation, rather than public airing of grievances.

More Compassionate and Realistic Approach: No-fault divorce acknowledges reality—relationships can end without assigning blame. It promotes a respectful and dignified process during a difficult life transition.

Potentially Reduces Domestic Violence Risk: In some cases, fault-based systems trap individuals in abusive relationships because proving fault could escalate conflict. No-fault divorce provides a safer and more accessible exit.

We urge policymakers to prioritize a legal framework that promotes:

Compassion and Fairness: Treating divorcing couples with dignity and respect.

Efficiency and Affordability: Streamlining the process and reducing financial burdens.

Reduced Conflict: Minimizing animosity and promoting cooperation, especially when children are involved.

Focus on the Future: Enabling individuals to move forward and rebuild their lives with less emotional and financial damage.

1. Different Divorce Model

There are essentially 2 model, Fault -based and no-fault divorce model, but India has only concept of fault-based divorce model. Let’s see the comparison chart.

Aspect

Fault-Based Divorce Model

No-Fault Divorce Model

Definition

One spouse must prove that the other is at fault for the breakdown of the marriage.

Neither spouse needs to prove fault; the marriage can end based on irretrievable breakdown.

Grounds for Divorce

Adultery, cruelty, desertion, mental disorder, conversion, venereal disease, etc.

Irreconcilable differences, incompatibility, or mutual decision to separate.

Burden of Proof

The petitioner (spouse filing for divorce) must provide evidence of wrongdoing.

No need to prove misconduct—just a declaration that the marriage has broken down.

Time Required

Can take several years due to legal battles and proving fault in court.

– — –

Emotional Impact

High stress and financial burden due to prolonged litigation and legal fees.

Less emotional strain as there is no allegations to prove

Status in India

India follows the fault-based model under the Hindu Marriage Act, requiring specific legal grounds for divorce.

No-fault divorce is not recognized in India; only the Supreme Court can grant divorce on the ground of irretrievable breakdown.

Status in Other Countries

— need to study

Common in Western countries like the U.S., Canada, U.K., France, Australia, etc..

2. Types of Divorce

2.1 Mutual Consent Divorce :

When both parties agrees to separate and file the divorce application jointly. Below are the law related to mutual consented divorce:

-> Section 13(b) of Hindu Marriage Act, 1955
-> Section 28 Special Marriage Act, 1954
-> Section 32(B) of Parsi Marriage and Divorce Act, 1936
-> Section 10A of Indian Divorce Act, 1869 (for Christians)

Section 29(2) of the Hindu Marriage Act, 1955 protects the validity of customary divorces. Tribes, some rural communities, and specific religious groups follow their own customary divorce practices.
