While India celebrates reforms that promote the ease of doing business, men continue to live under suspicion in their homes. This article explores the liberty gap that denies men trust, empathy, and emotional freedom in family life.

Ease of Doing Business vs. Ease of Being a Man

India takes pride in climbing the Ease of Doing Business rankings. Simplified regulations, single-window approvals, and digital governance reflect a belief that trust empowers people. When citizens are free from unnecessary control, the economy flourishes.

Yet this principle of liberty halts at the home’s threshold. Men are trusted in boardrooms but doubted in bedrooms.

In family disputes, the same government that trusts businessmen with billions doesn’t trust men with fairness. A single allegation can shatter reputations and lives. The presumption of guilt shadows men even before the first hearing begins.

The Pressure to Be Politically Correct

Modern men live under constant watch. Every word, reaction, or pause is examined through a gendered lens.

Express anger → “toxic.”

Stay silent → “indifferent.”

Assert a boundary → “controlling.”

Defend themselves → “insensitive.”

“Men must always be politically correct—not because they’re wrong, but because society expects them to be wrong.”, Kumar S Ratan

Meanwhile, women’s expressions of emotion are hailed as empowerment. Men’s expressions are viewed as aggression. This double standard suffocates authenticity and destroys genuine communication in relationships.

The Liberty Gap

India liberated its markets, not its men.
There are reforms for start-ups but none for fathers, husbands, or sons.

A businessman who fails is called “innovative.”
A husband who fails to please is called “abusive.”

Family courts and social norms have tilted so far that men must prove their innocence to earn basic respect. Fathers struggle for visitation; husbands fight stigma more than cases. The system meant for protection has turned punitive for one gender.

The Human Cost

This constant vigilance breaks men silently.
They suppress emotions, withdraw socially, and internalize guilt.
Mental-health issues among men—depression, anxiety, suicide—are rarely treated as a national concern, even though they stem from emotional injustice and societal neglect.

Time for Social Reform

India needs not only economic freedom but emotional freedom for men.

Just as we measure the Ease of Doing Business, let us measure the Ease of Being a Man.
Let it reflect:

Fairness in laws

Respect for men’s human rights and fathers’ rights

Recognition of men’s mental health

Equal empathy in family courts

Because a nation that ignores the well-being of its men cannot build healthy families—and without strong families, no economy can sustain growth.

Closing Thought

Ease of doing business strengthened India’s economy.
Now, we must strengthen its families by creating an Ease of Being a Man Reform.

A man trusted in the boardroom should not be broken in the courtroom.
He should not have to be politically correct to be respected— only human to be understood.

In today’s society, much focus is placed on advancing women’s rights, but the struggles men face are often ignored—not just by the public, but by lawmakers as well. While the feminist narrative commonly highlights male privilege, it overlooks the fact that many legal systems and societal norms impose significant restrictions and hardships specifically on men, often to their detriment.

This blog highlights the legal restrictions and societal restrictions are imposed only on men.

Unfair Burdens on Men

Laws are meant to ensure fairness and justice for all, yet it seem to target men disproportionately. One glaring example is in family law. Courts tend to favor mothers in custody battles, treating fathers as secondary parents who must prove their capability, while mothers are assumed to be the natural caregivers. Similarly, men often face unfairly high alimony payments, based on the outdated assumption that men are always the primary earners, even when this is no longer the case.

A more alarming issue arises with false allegations of rape and molestation, where men can have their lives destroyed by mere accusations. In many cases, no evidence is required to tarnish a man’s reputation, career, and personal life, while women who make these false claims rarely face any legal consequences, even when the truth is revealed in court. The legal system fails to hold false accusers accountable, leaving men defenseless against such life-altering accusations.

Societal Expectations with Masculinity

Beyond legal issues, societal expectations impose their own set of restrictions on men. Traditional gender roles pressure men into being the providers, the protectors, and the emotionally stoic figures in both family and society. Deviating from these roles often leads to judgment and ostracization.

Men are conditioned to “tough it out,” suppress their emotions, and remain resilient no matter what challenges they face. As a result, men are less likely to seek help when struggling with mental health issues, contributing to higher rates of depression and suicide. Unlike women, men receive far less support when they break under these pressures, as society views emotional vulnerability in men as a weakness.

Additionally, men are expected to take on dangerous and physically demanding jobs at much higher rates, such as in construction, military service, and emergency response. These roles expose men to greater risks of injury or even death, yet this is often treated as an expectation, rather than a choice. The sacrifices men make are seen as par for the course, further entrenching the narrative that men must bear the brunt of physical and emotional labor.

Impact of False Allegations and Double Standards

One of the most damaging double standards in modern society relates to how allegations of harassment, rape, and molestation are treated. While all allegations of such crimes must be taken seriously, the presumption of guilt often falls disproportionately on men. An accusation alone can ruin a man’s life—professionally, personally, and socially—long before any evidence is brought to light. This “guilty until proven innocent” approach leads to severe consequences, even when the accusations are later proven false.

Perhaps the most troubling aspect of this issue is the lack of repercussions for those who make false allegations. When a woman falsely accuses a man of rape or harassment, even if the claims are demonstrably proven to be lies, the legal system seldom punishes the false accuser. Courts are often reluctant to take action, allowing the individual who lied to walk away without facing any meaningful consequences. This double standard leaves men vulnerable, with their lives shattered, while the accusers face little to no accountability.

Toward True Gender Equality

Addressing the unique challenges men face requires a shift in both legal reform and societal attitudes. Lawmakers need to acknowledge and address the biases in laws related to family matters, as well as in handling false allegations of sexual misconduct. Courts should hold individuals accountable for false accusations, ensuring that men are not unfairly punished based on unverified claims.

At the same time, societal expectations surrounding masculinity must evolve. Men should be encouraged to express their emotions, seek help when needed, and challenge the traditional roles that pressure them into dangerous or emotionally suppressive positions. Only by recognizing and addressing these issues can we move toward a society that values fairness and justice for all, irrespective of gender.

It’s time to dismantle the myth that men face no challenges in our legal and societal structures. The restrictions imposed uniquely on men are real, and they deserve the same attention and advocacy that women’s issues have rightfully garnered.

In recent years, the misuse of Section 498A has gained widespread attention, even the Supreme Court of India and various Hight Courts has repeatedly acknowledged the increasing instances of false cases. In order to protect the innocent men, considering the highest rate of misuse it become important to discuss about counter cases against false 498a case.

Section 498A of IPC was introduced protect women from harassment and cruelty, primarily related to dowry demands. The gave the right to women to take legal action against their husbands and in-laws in in the said circumstances, ensuring justice.

What is False 498A Accusations

Before we talk about strategies of counter case against false 498A, it is essential to understand the common tactics used by those who misuse 498A. These often involve:

False allegations of dowry demand or harassment: Accusing the husband or his family of demanding dowry or subjecting the wife to physical or mental cruelty.

Fabricating evidence: Creating false evidence or manipulating existing documents to support the allegations.

Coercing witnesses: Pressuring relatives, friends, or neighbors to provide false testimony.

Exploiting legal loopholes: Taking advantage of the presumption of innocence and the stringent bail conditions often imposed in 498A cases.

Note that, after registration of FIR under section 498a, according to the process, the Police officer has to issue CrPC 41a notice to appear for the investigation. So after receiving such notice, you should join the investigation without fail and at the same time file for the anticipatory bail.

Steps to Defend Against False 498A Cases : You are not alone

File for Anticipatory Bail : File for Anticipatory Bail after registration of FIR, not before. Since 498A is a non-bailable offense, there is an immediate threat of arrest.

Stay Calm and Avoid Panic : As such false cases hurts men, so it become necessary to think with calm mind, your anger will bring you to different direction.

Gather Evidence: Collect all possible evidence that can prove your innocence. Keep all electronic evidences safe and ensure it was not removed from the device where it was originally captured.

Steps that may be helpful in Counter Case

Following provisions under which you can file counter cases:

In the changing society, the institution of marriage is undergoing significant scrutiny, particularly concerning its treatment of men within the family dynamic and in the societal norms.

Despite historical notions of respect and honor associated with marriage, the modern legal system fails to uphold the principles of equality for men.

In the modern legal landscape, men often find themselves navigating a system that seems to prioritize the rights and well-being of women and children over their own. From divorce proceedings to child custody battles, men frequently encounter biases and challenges that undermine their sense of respect and equality within the family structure.

Traditionally, marriage has been viewed as a sacred bond, symbolizing mutual respect, support, and partnership between spouses. However, with evolving societal norms and legal frameworks, the essence of respect for men within the family unit has come into question.

The rise of feminism, which promotes women’s empowerment in the name of gender equality, has adversely affected men and the institution of marriage. The feminist while talks about gender equality but they just talks about power and money to women without any responsibility on the cost of equality for men. So it’s crucial to ensure that such efforts do not come at the expense of men’s rights and dignity within the family unit or in the society.

Feminism often presents a biased view by highlighting issues such as the suicide rate among women while overlooking the comparable rate among men. This selective presentation aims to evoke sympathy, ignoring the stark reality that suicide rates among male are nearly twice as high. Similarly, discussions on rape cases often ignore the fact that over 70% of allegations against men are false, as revealed in the National Crime Records Bureau (NCRB) data. Despite these important concerns, there remains a significant lack of attention to the detrimental impact of false allegations on men’s well-being and their lives.

Moreover, when addressing child custody rights, despite efforts to promote gender-neutral custody laws, Courts tend to award primary custody to mothers, often leaving fathers with limited visitation rights and diminished roles in their children’s lives. This imbalance not only undermines the importance of paternal involvement but also perpetuates outdated stereotypes about gender roles in parenting.

In reevaluating the concept of marriage in the changing societal norms, it’s imperative to address these disparities and strive for a legal framework that promotes equality, respect, and fairness for all parties involved. This includes advocating for reforms that recognize the valuable contributions of men within the family and ensure their rights are upheld and protected.

Addressing men’s issues is crucial for achieving true gender equality. True gender equality means that all genders, including men, women, and non-binary individuals, have equal rights, opportunities, and protections under the law. The legal system should have provisions in place to ensure that men’s rights are recognized, respected, and upheld just as rigorously as those of any other gender.

Ultimately, marriage should be a partnership built on mutual respect, support, and equality, regardless of gender. Our society can move forward only by maintaining true gender equality and a safe environment for men.

The marital rape application which is pending at Delhi High Court making every effort to term the sexual intercourse between husband and wife as illegal?

The marital rape is the matter of transformation in the society and the rigid roles of husband and wife has to take a move, but certainly not a matter of criminalizing it. We are in 2022th the socio-economic setup & the traditions has changed.

Various rights like the right to life and dignity, the right to privacy, the right to freedom and the right against discrimination exists for both men and women, but the Marital Rape petition has been filed taking a view that these all rights are property of women.

If a men slapped with Rape like heinous cases, he will never get a job due to societal mindset. Considering the misuse of process of law at highest side in family dispute, the law will become a Men Destroying opportunity.

It is erroneous belief in the said petition, justifying rape in marriage based on a misconception, that the institution of marriage itself is originally founded on male supremacy over a woman’s body, which gives a man the right to assault his wife (spouse) as a corrective practice. The truth is that, marriage is a 7-birth bond, which is established based on belief and a small string can break the belief so the marriage institutions and the other aspect is that Patriarchy is just a myth. If the law has to come in the pressure of feminist arguments, then there should be provisions of automatic divorce and end the ways of mediation.

What are the way around:

This need to take care in various phases as:

Sensitization (Awareness in society)

Transformation in marriage system

Reform in consensual sex (Awakening the respect of consent in couples)

The division bench of Guwahati High Court while allowed the decree of divorce said refusal of wearing sindoor suffice refusal to continue conjugal life. The Bench added that, preventing husband from his legal duty to maintain aged parents is offence and may lead to punishment.

In the case, where respondent wife alleged that her husband and other family members harassed her for dowry, other side the husband argued that his wife repeatedly demanding separate residence after a month of the marriage.

Wife also asked her husband to fulfil her monetary demand, then only she will divorce.

“That I have objection regarding divorce in this case as because either he come to Dibrugarh to live with me or otherwise fulfil my demand i.e. monetary demand, only then I will divorce him.”

The bench also observed and recorded in the order;

“Under the custom of Hindu Marriage, a lady who has entered into marriage according to Hindu rituals and customs, and which has not been denied by the respondent in her evidence, her refusal to wear ‘sakha and sindoor’ will project her to be unmarried and/or signify her refusal to accept the marriage with the appellant. Such categorical stand of the respondent points to the clear intention of the respondent that she is unwilling to continue her conjugal life with the appellant. Under such circumstances compelling the appellant husband to continue to be in matrimony with the respondent wife may be construed to be harassment inflicted by the respondent upon the appellant and his family members.”

The bench reffering the “Rani Narasimha Sastri vs. Rani Suneela Rani” judgement, which clarified cruelty.

“It is true that it is open for anyone to file complaint or lodge prosecution for redressal for his or her grievances and lodge a first information report for an offence also and mere lodging of complaint or FIR cannot ipso facto be treated as cruelty. But when a person undergoes a trial in which he is acquitted of the allegation of offence under Section 498-A of IPC, levelled by the wife against the husband, it cannot be accepted that no cruelty has meted on the husband.”

The bench also observed from the lower court proceedings, that the respondent wife was preventing husband his legal duty to maintain aged parents.

“during the evidence that the respondent compelled and prevented the appellant from performing his statutory duties towards his aged mother under the provisions of the 2007 Act. Such evidence is sufficient to be construed as an act of cruelty as the non-compliance/non-adherence to the provisions of the 2007 Act has criminal consequences leading to punishment or imprisonment as well as fine.”
