Welcome to the world of financial exploitation.

The Alimony world (gujara bhatta) where laws are designed to scrutinize every single rupee a husband earns — or is capable of earning — while overlooks the wife’s financial standing. The system is biased, and the lawmakers have their eyes on every penny you make, but ignores the contribution or earning capacity of the wife.

This alimony calculator is based on the Supreme Court guidelines in Rajnish Vs Neha case, which the calculated result is based on certain assumptions and hypothesis, so the correctness of result is not assured.

The Court laid out that the quantum of maintenance/alimony should be based on following 8 factors alimony rule:

  • Status of parties and their lifestyle during marriage.
  • Earning capacity and income (actual and potential).
  • Needs of wife and dependent children.
  • Duration of marriage.
  • Age and health of both parties.
  • Child custody & financial responsibility.
  • Financial liabilities & dependents.
  • Contribution to household (monetary & non-monetary).

Notably, the duration of the marriage and the husband’s financial liabilities are not given due consideration. If the husband is jobless, the court assesses his earning capacity based on his financial records, such as income and expenditures from the past three years.

The financial capacity of the husband, his actual income, reasonable expenses for his own maintenance, and dependent family members whom he is obliged to maintain under law, would be required to be taken into consideration, to arrive at the appropriate quantum of maintenance.”, Supreme Court in Rajnish v. Neha, 2020

Liability

However the consideration is all on the court discretion. The burden of proof is on the husband to show these liabilities with documents for Bank statements, Loan EMIs, Medical bills, Parental dependency proof.
